The Association of American Universities, the Presidents’ Alliance on Higher Education and Immigration, and other groups filed suit against the U.S. Department of Homeland Security on Oct. 6, alleging the agency’s new guidance unlawfully narrows the Curricular Practical Training (CPT) program. For decades CPT allowed international students to pursue off-campus internships and training integral to their curriculum, including elective credit-bearing experiences; the August guidance limits eligibility to programs required for degree completion. The plaintiffs argue the change violates the Administrative Procedure Act by reversing settled agency interpretation without notice-and-comment rulemaking or reasoned explanation, and they seek to have the guidance struck down.
